Post-Decree Modifications & Enforcement

More than 36 years of experience in divorce and family law, serving Columbus, Delaware, and all of Ohio.

Life changes after the decree: incomes rise and fall, jobs move, children's needs evolve, and sometimes the other party simply stops complying. Post-decree work is either modification, changing an order because circumstances changed, or enforcement, making the existing order mean something through contempt.

Modifying support and parenting orders

Support modifications require a real change in circumstances, job loss, income change, remarriage effects, or the passage of plan-defined thresholds. Parenting modifications turn on the children's best interests. Timing and evidence matter; courts modify forward, rarely backward.

Contempt: enforcing what was ordered

Unpaid support, denied parenting time, and ignored property transfers are enforceable through contempt, with remedies including make-up time, judgment, attorney fees, and in serious cases jail. We prosecute and defend contempt with the documentation courts expect.

Questions We Hear First

Can spousal support be changed after divorce in Ohio?+

Only if the decree reserved jurisdiction to modify it and circumstances have substantially changed. If the decree is silent, support is usually fixed, which is why drafting mattered in the first place.

What happens if my ex violates the parenting schedule?+

Document every denial, then enforce through contempt. Courts can order make-up parenting time, fines, attorney fees, and schedule changes for chronic interference.

When can custody be modified in Ohio?+

Generally on a change in circumstances since the prior decree, when modification serves the child's best interest. The bar is real but far from insurmountable with the right record.
