Legal Separation in Ohio

More than 36 years of experience in divorce and family law, serving Columbus, Delaware, and all of Ohio.

A legal separation resolves everything a divorce does, property division, support, parenting, except the marriage itself remains intact. Couples choose it for insurance continuation, religious reasons, or timing considerations. The orders are just as binding as a divorce decree, so they deserve the same care.

Separation versus divorce

The proceedings look similar and the financial stakes are identical. The difference is status: after separation you are still married and cannot remarry. Many separations later convert to divorce, so we negotiate separation terms with that possibility explicitly in mind.

Questions We Hear First

What is the difference between legal separation and divorce in Ohio?+

Both divide property and set support and parenting orders. Divorce ends the marriage; separation leaves it intact, preserving things like some insurance and religious commitments.

Do I have to be legally separated before divorcing in Ohio?+

No. Ohio has no waiting-period requirement to file for divorce; legal separation is an alternative, not a prerequisite.

Can a legal separation be converted to a divorce?+

Yes. Either spouse can later pursue divorce, and the separation terms often shape the final decree, another reason to negotiate them carefully the first time.
